Conditions of Sale.

1. When you choose the operating system, you will receive the version of TLSTranscription for Macintosh and Windows and a license to deploy as many copies of the Testimony Software browser on Macintosh and Windows platforms for hard disc/CDROM/DVD and web delivery of your content using the JavaScript version of the Testimony Software browser;
2. Each license allows you to run a single copy of TLSTranscription on a single computer only.
3. Each license allows you to publish as many stories as you like on any platform using the Testimony Software Browser.
4. As we provide demonstration versions of Testimony Software, we offer no money back guarantee. If you are unsure of whether Testimony Software is fit for your purpose, download a demonstration version and satisfy yourself of the fit for purpose before you buy a license. 5. The Testimony Software browser has been fully tested with the Internet Explorer, Safari and Firefox browser at present. When other browsers are working, you will be notified of a change in versions and provided with download instructions. Current testing indicates that Testimony Software does not work 100% on other browsers and this is a high-priority issue we are addressing. However, we do not guarantee that Testimony Software will work on any browser due to the way that the writers of the browser may have chosen to support JavaScript, over which we have no control.
6. You receive free upgrades to TLSTranscription except for major revisions for which we will charge you a fee. This fee covers the programming and testing for the new versions. We define a major revision as an upgrade from, say version 3 to version 4, with minor revisions as version 3.0 to version 3.1.
7. You receive free upgrades to the Testimony Software browser except for major revisions for which we will charge you a fee. This fee covers the programming and testing for the new versions. 8. You get a single template set comprising a main or home page, a content page allowing video, audio, image and text containers for your content and the navigation bar container.
9. You are entitled to 20 hours of phone support during normal business hours, 9am-5pm Australian Eastern Standard time. Outside these hours, please contact us by email. If you need more phone support, please contact us to arrange extra cover.
10. We will provide unlimited free email support for the current version and immediately previous version only. For any older version, we will do what we can given the resources at our disposal but we do not guarantee to fix any bug or problem you are having. We reserve the right to answer your support request with a request to upgrade to the latest version.
11. Testimony Software is provided on an "as is" and "as available" basis without warranty, express or implied, of any kind or nature. You understand that we can not guarantee that Testimony Software will work on your computers, given the many ways that each computer can be configured and such configuration is outside of our control. What that means is that you may have made a change to your computer or installed some software that interferes with the running of Testimony Software and we can not be held responsible for any results of such changes and the running of Testimony Software even if there is damage caused to your hardware, software, operating system or data.
12. We have taken great care to test Testimony Software to ensure that it is as free of bugs and problems that we can but we do not guarantee that it is free of all bugs or problems. We guarantee to investigate all bugs and problems you notify to us and will attempt to fix all such bugs and problems in a timely manner. You agree to cooperate with us by providing necessary information and content files to assist us in investigating the causes for those bugs and problems. We will return to you or destroy, all content you have provided on the fixing of your reported bug unless you provide us with your approval, in writing, that we may retain such content for future testing purposes.
13. We accept no responsibility for any damage caused by your running of TLSTranscription on your computers, servers or any computers of users accessing your content through the Testimony Software browser.
14. You allow us to advertise your purchase of Testimony Software on our web site using a text statement and a link to your web site. If you are prepared to provide us with a suitable web version then we will include a copy of your logo.
15. In the event of any dispute, this contract of sale is entered into under the laws of the State of New South Wales, Australia, and all disputes will be addressed under the jurisdiction of the laws of the Sate of New South Wales, Australia.
